How to find if your parents have a will in India (NRI guide)

“Is there a will?” is one of the hardest questions in an NRI family — and one of the most searched after a hospital week. There is no national public database that lists every Indian will. You combine a calm conversation, paper trails, lawyer/CA clues, and locker notes. Do not turn the first Life Map call into a cross-examination. This guide covers discovery and continuity; a qualified advocate handles validity and probate.

There is usually no single search portal

Some wills are registered; many are not. Registration practices and search access vary by state and Sub-Registrar. Unregistered wills can still matter — and a registered will that nobody can find is almost useless. Discovery is operational, not a Google query.

  • Ask parents directly in peacetime if the relationship allows.
  • Ask whether a family advocate or CA drafted or holds a copy.
  • Check bank locker inventories and steel-cupboard packets.
  • Look for envelopes labelled will / testament / last wishes — without opening sealed legal packets improperly if counsel advises otherwise.

How to ask without a scare

  • Frame it as “so we know where important papers live if you are in hospital.”
  • You type; they talk — video call is enough.
  • Accept “not yet” or “won’t discuss” and still map everything else.
  • Never rewrite their wishes in a sibling group without them present.

Clues that a will (or draft) may exist

  • Advocate invoices mentioning drafting.
  • Notary / stamp-paper purchases in old diaries.
  • References in letters to “executor” or a named child.
  • Locker visit notes around the same date as other estate paperwork.
  • A scanned PDF in email titled will / testament — store location in the vault, not the group chat.

What to capture in the Life Map

  • Where the original is kept (locker / advocate / home).
  • Executor name if parents share it.
  • Date or year if known.
  • Advocate contact if any.

After death — if you still do not know

Search the home and locker under bank procedure, ask the family advocate, and check whether registration search is available for that district. Sibling conflict over a missing will needs counsel early — not WhatsApp polls.

  • Secure phones and papers first.
  • Inventory lockers with bank process.
  • Contact known CA / advocate.
  • Do not destroy drafts or envelopes.
  • Retain a lawyer if property or business stakes are large.
