Gratuity claim after death in India: what NRI families should prepare
Gratuity is easy to miss beside EPF and NPS — until an old appointment letter or Form 16 mentions it. After death, the employer’s HR or trust usually runs a nomination / legal-heir payout path with its own forms. NRI children need the last employer name, employee ID, and whether a nominee was filed. Map that while the member can still answer. This is a continuity checklist; confirm every step with that employer’s current process.
What gratuity usually is (plain language)
Gratuity is an employer-paid benefit for eligible employees under applicable law and the organisation’s scheme. On death, payment often goes to the registered nominee or to legal heirs under the employer’s rules. It is separate from EPF, NPS, and group insurance — treat each as its own Life Map item.
- Private employer vs government / PSU schemes — processes differ.
- Nominee on gratuity forms may not match bank or LIC nominees.
- Group term life or superannuation may sit beside gratuity on the same HR file.
- Contractors / informal work may have no gratuity — do not assume.
Peacetime capture for adult children abroad
- Last employer legal name and HR / payroll email or phone.
- Employee ID / PF number / UAN if linked on the same file.
- Whether a gratuity nomination form was ever submitted.
- Where appointment letters and relieving letters are kept.
- Add a Life Map item under employment / retirement the same day.
After death: documents families commonly gather
Exact lists come from that employer. Expect death certificate, claimant KYC, nomination or heir proofs, and bank details for credit. NRI claimants should align passport name spellings early.
- Death certificate copies.
- Claimant ID, PAN, and cancelled cheque / account proof.
- Nominee form copy if the family has it; otherwise ask HR what they hold.
- Legal heir / succession papers only if HR demands them for your case.
- Any pending salary / leave encashment claims — ask in the same letter.
Where gratuity claims stall
- Unknown last employer after decades — search old Form 16 / email domains.
- Company merged or renamed; HR trail broken.
- Nominee outdated after remarriage or a sibling’s death.
- Two siblings writing HR with conflicting instructions.
- Ignoring related EPF / group insurance on the same employer file.
